Modern Distribution Congress Regulations
(hereinafter: „Regulations”)

§ 1.
GENERAL PROVISIONS

1. The following Regulations (hereinafter „Regulations”) specify the terms and conditions for participation in the 2nd Modern Distribution Congress (hereinafter: “Congress”), which will be taking place on the 27th-28th of October, 2020.
2. The organiser of the Congress is the Modern Distribution Foundation seated in Warsaw, Aleje Ujazdowskie 41, 00-540 Warsaw, entered into the register of associations, other social and professional organisations, foundations and independent public health care facilities of the National Court Register kept by the District Court for the Capital City of Warsaw, XII Commercial Department of the National Court Register under KRS number 0000778339, REGON: 382913316, NIP: 7010915584 (hereinafter: “FND” or “Organiser”).
3. The Congress will be taking place in Warsaw at Sheraton Grand Warsaw, ul, Bolesława Prusa 2, 00-493 Warsaw.
4. Information about the Congress is available on the website www.dystrybucja.pl.
5. The condition of using the Services by the Participants is to read the Regulations and accept its provisions.
6. Participation in the Congress is open to all professionals, in particular people who conduct business or professional activities related to the subject of the Congress. The condition of participation in the Congress is the correct completion of the registration form on the website: https://dystrybucja.pl/en/registration/ and completing payment for participation in the Congress. In order to register, you must read the Congress’s regulations and accept them. FND is entitled to verify a person’s right to participate in the Congress by requesting the presentation of an identity document.
7. Participation in the Congress includes:
a. the recording the image of Participants in the form of analog or digital photographs, online streaming, videograms or audiovisual works during the Congress;
b. the processing of personal data in accordance with the Personal Data Protection Act of 10 May 2018 (Journal of Laws 2018, item 1000) and the General Data Protection Regulation (GDPR), including in particular, identifying badges of participants with the following personal information: name, surname, company.
8. The Annex to these regulations is the Privacy Policy available at: http://dystrybucja.pl/en/polityka-prywatnosci/ (hereinafter: Privacy Policy).
9. The organiser reserves the right to amend the provisions of these Regulations to the extent necessary for the proper running of the Congress.

§ 2.
DEFINITIONS

The definitions used in these Congress Regulations are given the following meanings:
1. Congress Organiser – Modern Distribution Foundation seated in Warsaw, Aleje Ujazdowskie 41, 00-540 Warsaw, entered into the register of associations, other social and professional organisations, foundations and independent public health care facilities of the National Court Register kept by the District Court for the Capital City of Warsaw, XII Commercial Department of the National Court Register under KRS number 0000778339, REGON: 382913316, NIP: 7010915584.
2. Congress Participant – a person conducting business activities, a legal person or an organisational unit without legal personality concluding a contract with the Organiser, obliged to pay the Organiser’s remuneration for participation in the Congress.
3. Applicant – a person making an online application on behalf of a Participant. Applicants can only be adults of full legal capacity.
4. Form – a form available to Participants on the Organiser’s website, enabling online application to the Congress.
5. Online application – completing the form and sending it to the Organiser via the Organiser’s Website https://dystrybucja.pl/en/.
6. Personal Data Administrator – Modern Distribution Foundation seated in Warsaw, Aleje Ujazdowskie 41, 00-540 Warsaw, entered into the register of associations, other social and professional organisations, foundations and independent public health care facilities of the National Court Register kept by the District Court for the Capital City of Warsaw, XII Commercial Department of the National Court Register under KRS number 0000778339, REGON: 382913316, NIP: 7010915584.

§ 3.
CONDITIONS FOR CONGRESS PARTICIPATION

1. The condition for participation in the Congress is the completed form available on the Congress website. By completing the form, the Participant is required to provide the following data:
a. full name;
b. position;
c. department;
d. company;
e. company address (street and number, post code, city);
f. phone number;
g. mobile number;
h. e-mail address;
i. company tax number.
2. By completing the registration form, the Applicant/Participant confirms that the data provided is true. Personal data is processed by FND on the principles set out in the Privacy Policy referred to in § 1 paragraph 7 above. The Applicant/Participant also confirms that they are authorised to act on behalf of and for the benefit of the Applicant in the conclusion of the Agreement with FND and that they have read the Regulations and accepts its contents.
3. Providing personal data is voluntary, but failure to provide it prevents participation in the Congress.
4. FND will inform the participant about registration via the registration form. They will then provide a proforma invoice indicating the date of payment, the cost of participation in the congress and the bank account number to which the payment should be made to the participant’s e-mail address provided by the participant during registration. After receipt of payment, FND will send the participant e-mail confirmation of participation in the Congress with a VAT invoice. By accepting the regulations, the participant agrees to receive the invoice electronically.
5. Collection of ID badges entitling to participate in the Congress takes place at the Congress on October 27, 2020 from 08:30. FND is entitled to verify a person’s right to participate in the Congress by requesting the presentation of an identity document.

§ 4.
PAYMENT AND CANCELLATION

1. The cost of participation in the Congressis:

a) 1.895 zł net (in words: one thousand eight hundred and ninety five PLN) + 23% VAT for applications made until 28.09.2020
b) 2.295 zł net (in words: two thousand two hundred and ninety five PLN) + 23% VAT for applications made after 28.09.2020 r.

2. The Organiser may introduce promotional codes entitling a reduction in the participation cost of the Congress. Any promotions cannot be combined.
3. The cost of participation in the Congress includes: participation in lectures, congress materials, coffee breaks, lunch.
4. There is no reimbursement of expenses incurred by the Congress Participants (e.g. travel expenses) due to participation in the Congress.
5. In the event of cancellation by September 28, 2020, we will charge you an administrative fee of 400 zł (in words; four hundred PLN) + 23% VAT.
6. In the event of cancellation after September 28, 2020, 100% of the participation fee + due VAT will be charged.
7. Failure to make payment is not synonymous with resignation from participation in the Congress.
8. Payments, in accordance with the pro-forma invoice received referred to in § 3 para. 4, should be made within 14 (fourteen) days of its receipt, however, before the day on which the Congress takes place, to the bank account number indicated on it.
9. Lack of resignation from participation in the Congress and not taking part in the Congress does not release the Participant from the obligation to pay remuneration for the Congress.

§ 5.
RESPONSIBILITY

1. Marketing of services or goods within the Congress is prohibited without the prior written consent of FND.
2. The participant is obliged to maintain a high level of personal culture during the Congress. It is forbidden to distribute any content prohibited by law or contrary to decency in the Congress.
3. FND reserves the right to remove any person who violates the provisions of the Regulations from the Congress area.
4. FND is entitled to document the course of the Congress and use the participant’s image in press or promotional materials related to the Congress, in particular recorded electronic media materials, press, brochures or leaflets. The Participant’s participation in the Congress is tantamount to agreeing to the image described in the preceding sentences use.
5. All liability of FND for non-performance of the agreement on participation in the Congress is limited to the amount of the fee incurred for participation in the Congress.

§ 6.
PERSONAL DATA PROTECTION

1. The Participants’ Personal Data Administrator is Modern Distribution Foundation seated in Warsaw, Aleje Ujazdowskie 41, 00-540 Warsaw, entered into the register of associations, other social and professional organisations, foundations and independent public health care facilities of the National Court Register kept by the District Court for the Capital City of Warsaw, XII Commercial Department of the National Court Register under KRS number 0000778339, REGON: 382913316, NIP: 7010915584.
2. Personal Data of Congress Participants will be processed in the scope of running the Congress.
3. The Personal Data Administrator exercises all diligence in the scope of personal data protection in accordance with applicable law.
4. Personal data of Congress Participants will be processed in accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (“GDPR”) and the Personal Data Protection Act.
5. Personal data is processed on the basis of: art. 6 para. 1 lit. a) GDPR, i.e. based on the consent of the data subject; Art. 6 para. 1 lit. f) GDPR – processing is necessary for the purposes of legitimate interests pursued by the Foundation or its partners.
6. Providing personal data in order to participate in the Congress is voluntary, and consent to receive commercial information may be withdrawn at any time by sending a statement to the FND e-mail address.
7. To the extent resulting from GDPR, the Company has concluded relevant data processing entrustment agreements.
8. Personal data will be stored by FND only for the period necessary to secure any claims or defend against any claims.
9. Any data subject may request from FND access to their personal data, rectification, deletion or limitation of processing as well as the right to object to the processing and the right to transfer data. In the event of a breach of the rules on the protection of personal data, the data subject may also lodge a complaint with the President of the Office for Personal Data Protection.

10. On the basis of a separate agreement concluded by FND with a third party, FND entrusts the processing of personal data within the meaning of the Regulation of the European Parliament and of the Council (EU) 2016/679 of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (“GDPR”). The third party referred to in the first sentence above is MM Conferences S.A., seated in Warsaw at ul. Długa 44/50, 00-241 Warsaw, entered into the Register of Entrepreneurs of the National Court Register kept by the District Court for the Capital City of Warsaw in Warsaw, XII Commercial Department under KRS number 0000300045, NIP 9522040486, REGON 141312256, share capital in the amount of 536,756.50 PLN. FND declares that the contract entrusting the processing of personal data to a third party referred to in the first sentence above is in accordance with the applicable provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (“GDPR”) and the Act on the protection of personal data, and website customers have all rights under the provisions of the GDPR.

§ 7.
FINAL PROVISIONS

1. The Congress Regulations are available on the Organiser’s website.
2. These Regulations may be changed, and each Participant will be informed about the content changes by the Organiser placing a message about changes to the Regulations on the Congress homepage.
3. Congress participants, by sending an application and by agreeing to the processing of personal data and the use of their image, accept the terms of these Regulations.
4. In matters not covered by these Regulations, the provisions of the Civil Code apply.
5. The Congress Regulations and the Privacy Policy form an integral part of the application form for participation in the Congress.
